The defence lawyer told the court she had contacted the Calgary Remand Centre but was told she could not speak with Martin while he was under hospital care.

Justice Mason made clear he wanted concrete details about whether Martin was conscious and the nature of his injuries, and he ordered the Crown to attempt to secure that information by the next hearing.
Prosecutors told the court Martin has a breathing tube and is unlikely to be able to provide instructions at present, a point that factored into the decision to adjourn the case.
The matter was put over to Thursday, Aug. 6, 2026, to allow time for an update on the accused’s medical condition and for the court to consider how to proceed given his incapacity.
Police say officer discharged firearm after confrontation
Calgary Police Service files show officers were called to the 1000 block of Bridlemeadows Manor S.W. in the early hours of July 30, 2026, following reports of a disturbance involving a man believed to be armed.
According to the policing timeline, the subject entered a residence prior to officers’ arrival and was engaged by police after they spent time attempting to take him into custody using police tactics.
Roughly two hours after the initial call, the man exited the residence and a confrontation ensued that culminated in an officer discharging a service firearm, leading to the man’s transport to hospital in critical condition; police later reported his status had been upgraded to stable.
Charges outlined by Crown in court
Martin faces multiple criminal charges stemming from the July 30 incident, including four counts of assaulting peace officers with a weapon.
Those charges remain before the court while medical updates are awaited and while the Crown continues its review of the officer-involved shooting.
The adjournment will allow prosecutors to collect and report relevant medical details and to advise the court on the accused’s ability to participate in his defence going forward.

In a separate ruling released Wednesday, Aug. 5, 2026, the Alberta Court of Appeal unanimously upheld a conviction in a Red Deer robbery that the court found also amounted to a sexual assault.
The appeal court confirmed that ordering accomplices to strip the victim and the subsequent removal of the victim’s clothing occurred in circumstances that violated his sexual integrity and therefore met the legal test for sexual assault.
The defendant in that case, 43-year-old Leon Daniel Roan, was one of several people involved in a June 15, 2022, attack in which the victim was stripped of clothing and personal items; Roan’s sentence was 5½ years and the appeal judges found no error in the trial judge’s findings.
Martin’s case remains pending while the Crown and defence await medical information and the court determines how to preserve the accused’s rights during his recovery.
